Generally, prostitution is defined as the act of knowingly engaging in or offering or agreeing to engage in sexual conduct for a fee, or soliciting another in a public place to engage in sexual conduct for hire. The parties to the crime usually include: a prostitute and a customer or a third person/pimp. Additionally, soliciting prostitution, agreeing to engage in an act of prostitution, child prostitution, attempted prostitution are other prostitution related offenses.
Prostitution is a Class “B” misdemeanor punishable by up to 180 days in county jail, unless the person charged is a repeat offender. If one (1) or two (2) previous convictions of prostitution, then the punishment translates to a Class “A” misdemeanor punishable by up to one (1) year in county jail. If convicted three (3) or more times previously, then the punishment becomes one of state jail felony.
In all instances, the punishment for prostitution is the same, whether the person is offering to engage in sexual conduct for a fee or is offering to purchase those services.
